Resolved by the Commission of the City of Battle Creek:

The City of Battle Creek has received a request from Schweitzer Inc., as owner of at least 50% of all taxable value of property located in the proposed district, to establish an Obsolete Property Rehabilitation District under the provisions of Act 146 of the Public Acts of 2000, within the City of Battle Creek on property described as:

1. The City Commission of the City of Battle Creek shall hold a hearing on February 16, 2016, beginning at 7:00 PM in the City Commission Chambers in City Hall, Battle Creek, Michigan, for the purpose of affording a hearing to the owners of real property within the proposed Obsolete Property Rehabilitation (OPRA) District and any other resident or taxpayer of the City of Battle Creek on the establishment of the proposed OPRA District, the City Assessor and a representative of each taxing unit which levies ad valorem property taxes in the City of Battle Creek on the real property and personal property assessable as real property located in the proposed OPRA District as required by Section 3(3) of Act 146.

 

2. The City Clerk shall give written notice by certified mail to the owners of all real property in the proposed OPRA District, and written notice to the City Assessor, and the legislative body of each taxing unit which levies ad valorem property taxes on the real property and personal property assessable as real property of the applicant located in the proposed OPRA District of the date, time and place of the previously mentioned hearing, and that the City Commission shall afford owners of the real property within the proposed District, residents and tax payers of the City, the Assessor and a representative of each such taxing unit an opportunity to be heard with respect to the establishment of the proposed OPRA District

BUDGETARY CONSIDERATIONS

Establishing an Obsolete Property Rehabilitation District does not, itself, have any budgetary considerations.  However, the purpose of establishing the district is to allow a property owner to request an Obsolete Property Rehabilitation Tax Abatement so that the property owner can receive a property tax abatement for a period of years which assists the property owner in offsetting the costs of rehabilitating an obsolete property.  The budgetary considerations for that will be addressed in a subsequent resolution.


HISTORY, BACKGROUND and  DISCUSSION

Schweitzer Inc. is seeking to rehabilitate a vacant warehouse storage building located at 86 South Division Street.  Schweitzer Inc. wishes to renovate the current building for their office and equipment storage.  They have expressed interest in using available economic development tools to assist their efforts.  One of those tools available in the City of Battle Creek, due to its status as a "Core City", is the Obsolete Property Rehabilitation Tax Abatement, where the property qualifies as obsolete property in an Obsolete Property Rehabilitation District.  This resolution sets the public hearing necessary in the process of establishing an Obsolete Property Rehabilitation District.   After the public hearing the City Commission will be asked to adopt a resolution establishing the Obsolete Property Rehabilitation District No. 14.

An OPRA district must be established before an application can be submitted or any rehabilitation work can begin.
