BATTLE CREEK, MICHIGAN - 6/21/2016

Resolved by the Commission of the City of Battle Creek:

 

That the City Manager is authorized to sign the First Amendment to Land Lease, Memorandum of Lease with Alltell Communications Wireless, Inc., d/b/a Verizon Wireless, as is attached to this Resolution, for a cellular tower installed on City property at McCrea Park and any other documents necessary to effectuate the lease amendment.

HISTORY, BACKGROUND and  DISCUSSION
Since 1994 the City and Century Cellunet (the predecessor in interest to Verizon Wireless) have had a lease for a cellular tower on City property at McCrea Park.  That lease has expired and the parties desire to continue the lease for a five (5) year term with options for two (2) additional five (5) year terms.
DISCUSSION OF THE ISSUE

The Department of Public Works and the City Attorney's Office support the resolution.
