A Resolution amending Chapter 274 of the Battle Creek Ordinances governing the Human Relations Board.

BATTLE CREEK, MICHIGAN - 6/21/2016

Resolved by the Commission of the City of Battle Creek:

 

That Ordinance No. 06-2016 introduced June 7, 2016, which amends Chapter 274, the "Human Relations Board," to update the purpose and duties and eliminate reference to specific discriminatory practices which are already covered in other ordinances:.

 

Section 1. An ordinance to amend Chapter 274, the "Human Relations Board," to update the purpose and duties and eliminate reference to specific discriminatory practices which are already covered in other ordinances, as is attached and made a part hereof.

 

Section 2. Should any section, clause or phrase of this Ordinance be declared to be invalid, the same shall not affect the validity of the Ordinance as a whole, or any part thereof, other than the part so declared to be invalid.

 

Section 3. All ordinances or parts of ordinances, in conflict with any of the provisions of this Ordinance, are hereby repealed, saving any prosecution, criminal or administrative appeal pending on, or violation cited on or before the effective date of this ordinance, which shall remain subject to the ordinance provision existing at the time of the alleged violation.

 

Section 4. This Ordinance shall take effect ten (10) days from the date of its adoption, in accordance with the provisions of Section 4.3(B) of Chapter 4 of the City Charter.

HISTORY, BACKGROUND and  DISCUSSION

The Human Relations Board was established in 1986. Ordinance revisions were made in approximately 1995; however, until last year there had been no members on the Board since the expiration of terms in 1995, thus it had been inactive.

 

Since the board member appointments in 2015, the Board has met on a regular basis. Among its activities, the Board reviewed and has recommended revisions to this Chapter of the Ordinances. Among the proposed revisions which were introduced in ordinance 06-2016 on June 7, 2016, are:

 

1)  the elimination of specific discriminatory practices since those are already covered in Chapter 214 of Ordinances, as well as in several other places in the Ordinances;

 

2) an update of the types of differences among people which can cause problems in relationships that are not conducive to a thriving City;

 

3) eliminating of cross references to state statutes that have been repealed; and

 

4) removal of penalty provisions under this chapter of ordinances since this board is intended to be advisory in nature.
