A Resolution setting a Public Hearing for Tuesday, September 6, 2016, for the purpose of reviewing and receiving public comment on a request to vacate the portion of Division Street south of Fountain Street.

BATTLE CREEK, MICHIGAN - 8/16/2016

Resolved by the Commission of the City of Battle Creek:

 

The City of Battle Creek, in accordance with Section 1020.20 of the Codified Ordinances of the City of Battle Creek, is required to hold a public hearing on all street and right-of-way vacation requests.

  

Pursuant to the requirements of Chapter 1020, : "Streets and Excavations", Section 1020.20 "VACATION OF STREETS",  it is resolved that the Battle Creek City Commission will hold a Public Hearing to receive citizen comments on the request to vacate Division Street south of Fountain Street on September 6, 2016, in the City Commission Chambers, City Hall, Room 301. 

 

The City Clerk shall publish a notice of the public hearing in a newspaper of general circulation no later than 14 days prior to the public hearing. The Planning Department will also provide notice of the public hearing via first class mail to all owners of property, according to City Assessor records, located within 300 feet of the portion of alley-way to be vacated.

SUMMARY 

A Resolution setting a Public Hearing for Tuesday, September 6, 2016, for the purpose of reviewing and receiving public comment on a request to vacate the portion of Division Street south of Fountain Street.


BUDGETARY CONSIDERATIONS
The vacation of the street would have nominal impact to the City budget, mainly resulting from the decrease in maintenance that would be required.

HISTORY, BACKGROUND and  DISCUSSION

City staff has been working with adjacent owners on the redevelopment of this area that would require the vacation of this portion of Division Street. The portion at the railway was vacated earlier this year.


DISCUSSION OF THE ISSUE

POSITIONS

Various City departments have been involved with the quiet zone project and planning for future redevelopment of this area including the City Manager's Office, Department of Public Works, Planning, Transit, and Downtown Development.
