A Resolution establishing Obsolete Property Rehabilitation District No. 16.

BATTLE CREEK, MICHIGAN - 12/20/2016

Resolved by the Commission of the City of Battle Creek:

 

The City Commission of the City of Battle Creek held a public hearing on December 20, 2016, at 7:00 PM in the City Commission Chambers, City Hall, Battle Creek, Michigan, for the purpose of establishing an Obsolete Property Rehabilitation District No. 16 under the provisions of Act 146 of the Public Acts of 2000, within the City of Battle Creek on property described as:

 

BC CITY RANGE OF BLOCK NO. 3 LOTS 68, 69, 74 & 75, EXCLUDING THE SOUTHWESTERLY 111.5 FEET OF LOTS 74 & 75, THEREOF, TOGETHER WITH AN EASEMENT FOR INGRESS & EGRESS TO A LOADING DOCK AT THE NORTH END OF LOT 75, ACCORDING TO THE PLAT THEREOF RECORDED IN LIBER 2 OF PLATS, PAGE 42 IN THE OFFICE OF THE REGISTER OF DEEDS FOR CALHOUN COUNTY RECORDS.

 

Commonly Known as: 103 Michigan Avenue West

 

 

A Notice of Public Hearing was provided to the owners of all real property within the proposed district and the public as required by Act 146 of the Public Acts of 2000; and

 

            The City of Battle Creek is a qualified local governmental unit under Act 146 of the Public Act of 2000 pursuant to Section 2(k) of said Act.  The City of Battle Creek desires to establish an Obsolete Property Rehabilitation District and has notified the owner(s) of all taxable property located within the proposed district, and

 

            The City of Battle Creek finds and determines that the proposed Obsolete Property Rehabilitation District meets the requirements of said Act because the parcel or tract of land to comprise the district is obsolete property as defined by Act 146 of the Public Act of 2000 in an area characterized by obsolete commercial property.

 

            The City Commission deems it to be in the public interest of the City of Battle Creek to establish the above described real property located within the City of Battle Creek as Obsolete Property Rehabilitation District No. 16.

BUDGETARY CONSIDERATIONS

Establishing an Obsolete Property Rehabilitation District does not, itself, have any budgetary considerations.  However, the purpose of establishing the district is to allow a property owner to request an Obsolete Property Rehabilitation Tax Abatement so that the property owner can receive a property tax abatement for a period of years which assists the property owner in offsetting the costs of rehabilitating an obsolete property.  The budgetary considerations for that will be addressed in a subsequent resolution.


HISTORY, BACKGROUND and  DISCUSSION

Jay Andrew Development Co., LLC is seeking to rehabilitate this property into an up to date restaurant and residential mixed use.  They have expressed interest in using available economic development tools to assist their efforts.  One of those tools available in the City of Battle Creek, due to its status as a "Core City", is the Obsolete Property Rehabilitation Tax Abatement, where the property qualifies as obsolete property in an Obsolete Property Rehabilitation District.  This resolution establishes an Obsolete Property Rehabilitation District No. 16.

An OPRA district must be established before an application can be submitted or any rehabilitation work can begin.
