Resolved by the Commission of the City of Battle Creek:
The City Manager is authorized to execute Contract No. 2017-46C with Smeal Fire Apparatus Co. for one quint fire apparatus in a not-to-exceed amount of $978,000.00.
The City Manager or her designee is also authorized to execute change orders up to 10% in aggregate for City-initiated and pre-approved changes during this project.
The contract will be paid from GL 409.13.4391.972.020
I, Victoria Houser, City Clerk of the City of Battle Creek, hereby certify the above and foregoing is a true and correct copy of a Resolution adopted by the Battle Creek City Commission at a Regular meeting held on January 3, 2017.

The City’s Fire Department is in need of a fire apparatus to replace the two fire apparatus removed from service in October, 2016, due to cracked frames.
Fire Chief, David Schmaltz attached memo details the background and justification to purchase a new vehicle rather than repair the current vehicles.
The City’s Administration Code provides exceptions to the sealed bid requirement, when it is in the City’s best interest to do so. In this case, the proposal was submitted to the Fire Chief, David Schmaltz directly. Chief Schmaltz has reviewed the proposal, the specifications and the vehicle in detail and recommends to award the contract to Smeal Fire Apparatus Co.
I concur with the department’s recommendation that contract award to this firm would be in the best interest of the City of Battle Creek.
