Per Resolution No. 22, dated 12/6/16, a Wastewater Technical Review Committee was created consisting of the following:
i. two representatives from each of the five Contributing Jurisdictions
including:
1. either the Contributing Jurisdiction’s manager/supervisor or one of
its elected officials, and
2. one person having relevant engineering or other technical expertise
ii. five representatives from the City including:
1. at least one elected City official
2. the Battle Creek City Manager or designee
3. the City’s Plant Supervisor or designee, and
4. at least two people having relevant engineering or other technical
expertise
iii. two Industry Representatives selected by a majority vote of the above
members
The Committee's responsibilities are as follows:
i. Within that limitation, the Committee’s responsibilities shall include
reviewing the:
a. area-wide needs of the Wastewater Treatment System, including
service extensions, treatment requirements, sludge disposal, etc.;
b. budgetary needs of the Wastewater Treatment System;
c. financial requirements of the Wastewater Treatment System;
d. City’s 5-year capital cost projections;
e. proposed annual budget and service level of the Wastewater Treatment
System;
f. rate studies identified in Section 6;
g.independent rate consultant’s work and proposed rate adjustments;
and/or
h. such other matters as the parties deem appropriate for the overall
benefit of the Wastewater Treatment System and for the good will of
all participating governmental units.
ii. Within that limitation, the Committee’s responsibilities shall also include
advising the City’s Commission with respect to:
a. its adoption of a budget for the Wastewater Treatment System;
b. its proposed rate adjustments; and
c. the area-wide needs of the Wastewater Treatment System.
iii. When consulted by the City about capital improvements related to interceptor
sewers in accordance with Section 3(c), the Committee shall make a
recommendation within ninety (90) days to the City about the overall scope
and approach that should apply to the capital improvement.
iv. Upon notification by the City of its intent to change charges or rates, the
Committee shall develop a RFP/RFQ process and have the option to lead
and/or participate in any and all related RFP/RFQs aimed at assisting the
City’s Commission in selecting an independent rate consultant as referenced
in Section 6 of this Contract. Within one hundred-twenty (120) days of being
notified by the City of its intent to change charges or rates, the Committee
shall make a recommendation to the City’s Commission about which
consultant the City should engage.
