A Resolution authorizing the City of Battle Creek to purchase property under First Right of Refusal for tax reverted parcel,0077-00-550-0, on South Helmer Road. 

BATTLE CREEK, MICHIGAN - 9/1/2015

Resolved by the Commission of the City of Battle Creek:

 

That, in accordance with PA 123 or 1999, Battle Creek has the First Right of Refusal, to acquire certain tax-foreclosed parcels in Calhoun County, Michigan.  At this time, the City is exercising its right to purchase the following parcel for public purpose at the minimum bid from the Calhoun County Treasurer's 2015 tax foreclosed parcels: Parcel # 0077-00-550-0; S. Helmer Road.

 

This parcel is adjacent to and will become an extension of the City-owned cemetery located at 13390 Helmer Rd, parcel number 0077-00-560-0.  

 

The City Manager is authorized to purchase the property on South Helmer Road, Parcel No. 0077-00-550-0

BUDGETARY CONSIDERATIONS

The City of Battle Creek is responsible for paying all outstanding property tax for this parcel in addition to the cost to record the deed.

HISTORY, BACKGROUND and  DISCUSSION

Each year the City of Battle Creek reviews certain tax-foreclosed parcels to determine if the City's First Right of Refusal should be exercised.  In accordance with PA 123 or 1999, acquired parcels must be used for public purpose. 

 

This parcel is south of I-94, and adjacent to the east bound on-ramp at Helmer. The parcel is 50' and 10,277 s.f. (.24 acre) in size. Although the property is zoned commercial, the size and location would make future development impossible except for a driveway which would not be appropriate or safe this close to the on-ramp.
