A Resolution setting a Public Hearing for Tuesday, October 6, 2015, for the purpose of receiving public comment on a request to vacate a portion of the Morley Street right-of-way that lies north of Cornell Drive.

BATTLE CREEK, MICHIGAN - 9/15/2015

Resolved by the Commission of the City of Battle Creek:

 

The City of Battle Creek, in accordance with Section 1020.20 of the Codified Ordinances of the City of Battle Creek, is required to hold a public hearing on all street and right-of-way vacation requests.

 

Pursuant to the requirements of Chapter 1020, : "Streets and Excavations", Section 1020.20 "VACATION OF STREETS",  it is resolved that the Battle Creek City Commission will hold a Public Hearing to receive citizen comments on the proposed vacation of the Morley Street right-of-way that extends north of Cornell Drive, herein described: EASTAVELAND THAT PART OF MORELY AVE, AS OCCUPIED, BOUND ON THE S BY CORNELL DR, BOUND ON THE N BY THE N LI OF LOTS 87 & 88 EXTENDED ((ASSESSED AS NON-TAXABLE STREET RIGHT-OF-WAY PRIOR TO 2003)) on October 6, 2015, in the City Commission Chamber, City Hall, Room 301. 

 

The City Clerk shall publish a notice of the public hearing in a newspaper of general circulation no later than 14 days prior to October 6, 2015. The Planning Department will also provide notice of the public hearing via first class mail to all owners of property, according to City Assessor records, located within 300 feet of the portion of alley-way to be vacated.

BUDGETARY CONSIDERATIONS
There are no budget considerations for this request.

HISTORY, BACKGROUND and  DISCUSSION

This portion of right-of-way extends north from Cornell Drive, and is adjacent to three privately owned properties. To each side is a single family residential property; once vacated, per State law the right-of-way will be split and land combined with these properties on each side. To the north is Beacon Ridge condo development, which does not need this right-of-way for access, nor did approval of the development consider this right-of-way as access for that site. 


DISCUSSION OF THE ISSUE

POSITIONS
Planning staff has contacted DPW and Assessing and they have no opposition to the request to vacate.
