Resolved by the Commission of the City of Battle Creek:
That a Closed Session of the City Commission shall be held immediately following the Commission Comments section of the regular meeting on Tuesday, June 20, 2017, in Room 302A, City Hall, Battle Creek, Michigan. The Michigan Open Meetings Act (OMA) permits a public body, upon a 2/3 majority vote, to meet in closed session under Section 8(e) in order "To consult with its attorney regarding trial or settlement strategy in connection with specific pending litigation, but only when an open meeting would have a detrimental financial effect on the litigation or settlement position of the public body;"
and that, Rebecca L. Fleury, City Manager, is hereby appointed as the designated secretary to record and prepare appropriate Minutes of this Closed Session.
I, Victoria Houser, City Clerk of the City of Battle Creek, hereby certify the above and foregoing is a true and correct copy of a Resolution adopted by the Battle Creek City Commission at a Regular meeting held on June 20, 2017.
