A Resolution accepting the resignation of Michael Sherzer as Ward 4 Commissioner and appointing John Godfrey to fill the vacancy for the remainder of Michael Sherzer's term.

BATTLE CREEK, MICHIGAN - 9/5/2017

Resolved by the Commission of the City of Battle Creek:

 

Michael Sherzer, Ward 4 Commissioner with a term expiring in November 2017, has submitted his resignation from the position effective August 25, 2017, at 5 pm.

 

Battle Creek’s City Charter, Section 2.6, requires the City Commission to appoint, by a majority vote, a qualifying individual to fill the remainder of the term within 30 days where more than 60 days remain prior to the next election.

 

John Godfrey is a resident of Ward 4 and is both a former mayor and former commissioner for the City of Battle Creek.

 

Consistent with the vote of the Commission at the August 15, 2017, meeting, John Godfrey is appointed Ward 4 City Commissioner to serve until November 14, 2017, when the newly elected candidate is sworn and assumes office.

SUMMARY

BUDGETARY CONSIDERATIONS
The individual appointed to fill this position will receive the same compensation as Michael Sherzer and other commissioners so this resolution is budget neutral.

HISTORY, BACKGROUND and  DISCUSSION

Michael Sherzer was elected to a second two-year term as the Ward 4 City Commissioner in November 2015. He announced at the August 15, 2017, meeting that he was selling his home and moving outside the City of Battle Creek and anticipated that would occur by the end of August, 2017. Once he moved, he would no longer be eligible to serve as the Ward 4 City Commissioner.

 

At the same meeting, various commissioners expressed that they did not wish to appoint one of the four individuals who are currently candidates for Ward 4 Commissioner at the November 7, 2017 election so as not to give anyone an advantage of being the incumbent. A number of commissioners also expressed a desire to appoint someone who has previously served on the commission, hoping for a more successful transition due to past experience since there are only four regular meetings scheduled to complete the term.

 

At the August 15, 2017, meeting the commission voted 7-2 in support of a motion to appoint John Godfrey to fill the vacancy in the event that Michael Sherzer were to resign before September 8 and if John Godfrey were willing to accept the appointment. 

 

On August 22, 2017, Michael Sherzer submitted his resignation letter, to be effective August 25, 2017, at 5 pm. It is attached. John Godfrey has indicated his willingness to accept this appointment.
