A Resolution authorizing the City Manager to execute all documents necessary to sell the city-owned land at 610 W Columbia Avenue, Parcel #0614-19-221-0, as well as vacant land the City is purchasing pursuant to Resolution 190 approved 9/5/2017 from the State of Michigan, located on Columbia Avenue and LaVista Blvd to Philip VanVranken for $125,000.

BATTLE CREEK, MICHIGAN - 11/21/2017

Resolved by the Commission of the City of Battle Creek:

 

That, Section 12.1 of the Charter of the City of Battle Creek authorizes the City to sell real property and the City believes it is in its best interest to do so in this instance. 

 

The City Manager is authorized to sell the city-owned land at 610 W Columbia Avenue, Parcel #0614-19-221-0, as well as vacant land the City is purchasing pursuant to Resolution 190 approved 9/5/2017 from the State of Michigan, located on Columbia Avenue and LaVista Blvd to Philip VanVranken for $125,000 pursuant to the terms, and as legally described in the attached purchase agreement. 

 

Rebecca L. Fleury, the City Manager of Battle Creek, is authorized to execute any required closing documents including, but not limited to, the Quit Claim Deed to effectuate this sale.

SUMMARY

BUDGETARY CONSIDERATIONS

The City will be paid $125,000 for the sale of this property; however, we will also be responsible for the cost of demolition of the structure on the property which is anticipated will cost $26,900; $36,000 for the purchase of the vacant land from the State of Michigan; and other closing costs which are not anticipated to exceed $2,000.

 

The revenue from the sale of the property will go to 401.50.1401.673.010.

The cost of the demolition will be paid from: 401.50.4200.801.310.

The purchase of the vacant land from the state will be paid from: 401.50.4200.971.010.


HISTORY, BACKGROUND and  DISCUSSION

Many of the Michigan State Police (MSP) posts were located on property containing reversionary clauses indicating that if it ever ceased to be used as an MSP post, then the property would revert to the municipality. MSP ceased using this property as a post and it reverted to the City pursuant to the terms of the 1938 deed. The City has had this property listed for sale for several years since it has no use for it, and this is the highest and best offer for the City.
