A Resolution to appoint members to the City Attorney Evaluation/Salary Review Committee, and changing the membership guidelines to include alternates and extending the terms of all members to the end of 2018.

BATTLE CREEK, MICHIGAN - 1/2/2018

Resolved by the Commission of the City of Battle Creek:

 

That the following members are appointed to the City Attorney Evaluation/Salary Review Committee:

 

  • Commissioner Christopher Simmons is appointed, replacing Deborah Owens, with a term to expire on December 31, 2018.
  • Commissioner Sherry Sofia is appointed, replacing Michael Sherzer, with a term to expire on December 31, 2018.

 

And that, the term expirations of Vice Mayor David Walters and Commissioner Susan Baldwin shall be extended to December 31, 2018.

 

And that, the membership shall be updated to allow the Mayor and City Commission to appoint two members of the City Commission as alternates to attend meetings only in the event of the unavailability of an appointed City Commission member.

 

The following commissioners are appointed to the City Attorney Evaluation/Salary Review Committee as alternates:

 

  • Mayor Mark Behnke
  • Commissioner Kate Flores

None.

HISTORY, BACKGROUND and  DISCUSSION

Resolution No. 53 dated May 12, 1987, approved the creation of the City Attorney Evaluation/Salary Review Committee making its purpose is to conduct an annual assessment of the City Attorney's salary, benefits, etc. 

 

Resolution No. 74 dated May 17, 1988, approved the Committee having the power to also review the City Attorney's agreement and performance pursuant to the Attorney's contract and to consider the salary-opener provision of the contract.

 

Resolution No. 153 dated June 7, 2016, redefined the purpose of the committee to include the power to negotiate a renewal or extension of the City Attorney's contract.

 

Resolution No. 140 dated June 20, 2017, redefined the purpose of the Committee  to include making an annual assessment of the City Attorney's performance, including a review of her salary, benefits, and any other related matters or contract issues to come before the Committee, and specified that the Committee will provide its recommendations to the full Commission.
