Resolved by the Commission of the City of Battle Creek:

 

The City Manager is authorized to execute contract #2018-079C with Michigan Office Environments for furniture for the new police building, in an estimated amount of $413,389.91, with unit prices prevailing.  
 
This contract will be paid from 409.14.4390.972.010

The City Manager or her designee is also authorized to approve change orders for up to 2% in aggregate for City-initiated and pre-approved changes for unforeseen items that arise that do not have contracted unit prices.

BUDGETARY CONSIDERATIONS

HISTORY, BACKGROUND and  DISCUSSION
The new police headquarters is now at a stage where it’s time to order the furniture.  See Police Chief Blocker’s attached memo for more detail.

The State of Michigan, through its MiDeal program, has publicly competed and negotiated certain contracts on behalf of over 1000 smaller public agencies (e.g., cities, townships, counties, schools, hospitals, tribes), to leverage the power of economy of scale for such things as road salt, janitorial supplies and office supplies. Two of those available MiDeal contracts are for furniture from Haworth, with Michigan Office Environments as its approved distributor/installer:  071B7700023 and 071B7700074.

Kathy Schley, with approval from Purchasing, contacted the MiDeal contracted vendor, Haworth, to evaluate the current spaces and obtain a system and pricing to best fit the needs of the police department.  The designers worked with Ms. Schley to come up with pricing for all items, with specific unit prices, and it is not likely to exceed the amount of $413,389.91, but writing the resolution for “estimated with unit prices prevailing” gives the police department flexibility during the installation to make small changes.  The price also includes delivery and installation.

Haworth, with its long standing reputation for quality furniture, uses Michigan Office Environments as its approved distributor/installer.  Haworth has been vetted by the State, approved for our use, and provided special pricing as a result of the extended purchasing contract.

The City of Battle Creek Administration Code allows for purchases outside of the bid process if it’s in our best interest to do so. We have bought off the State of Michigan extended purchasing publicly bid contracts when it’s in our best interest for more than 30 years because we have blanket authority to do so (reso #78 dated 6/15/82).  However, due to this unusually high dollar amount, we are seeking specific directed authority for the City Manager to sign this agreement.
