A Resolution authorizing the City of Battle Creek to accept title to land located at 276 E. Michigan, Battle Creek, from Beverly Bishop.

BATTLE CREEK, MICHIGAN - 5/15/2018

Resolved by the Commission of the City of Battle Creek:

 

The structure at 276 E. Michigan has been condemned as a result of a fire.  The property owner desires to convey the property to the City of Battle Creek at no cost to the City.

 

Section 12.1 of the Charter of the City of Battle Creek authorizes the City to accept title to real property and the City believes it is in its best interest to obtain title to this real estate for land assembly and development. 

 

The City Manager is authorized to accept title from Beverly Bishop on behalf of the City by Quit Claim Deed for the land located at 276 E. Michigan Avenue in Battle Creek, tax parcel #0890-00-011-0 and legally described as:

 

Lot 10 of the Assessor’s Replat of Beaches Addition, according to the Plat thereof recorded in Liber 9 of Plats, on Page 8, in the Office of the Register of Deeds for Calhoun County, Michigan.

 

In exchange for the conveyance of this property, the City Manager may execute the attached release of Ms. Bishop from responsibility for outstanding code violations, which will be resolved upon its demolition.

BUDGETARY CONSIDERATIONS

The demolition costs of this specific parcel will be funded by the Calhoun County Land Bank. 

 

 The City will be responsible for the 2018 real property taxes, estimated to be $506.17 to be paid from G/L 101.12.8010.955.040.


HISTORY, BACKGROUND and  DISCUSSION

276 E. Michigan suffered a structure fire on August 22, 2016.  Subsequently, the property was condemned and ordered to be demolished.   The current property owner has cleared up several title issues but has not demolished the structure. 

 

There are outstanding code violations on this property, including that it has been destroyed by fire and the property has not yet been demolished. The City has agreed that in exchange for the conveyance of this property, the owner will no longer be responsible for the outstanding code violations.

 

The City owns several adjacent parcels and City ownership of this parcel will lend itself to land assembly and development.
