HISTORY, BACKGROUND and  DISCUSSION

On January 6, 1998, the City Commission of the City of Battle Creek, Michigan adopted a resolution to create the City of Battle Creek Brownfield Redevelopment Authority ("Authority") and to designate the boundaries of the Brownfield Zone within which the Authority will exercise its powers. The Brownfield Zone to which this plan applies consists of the properties within the boundaries of the City of Battle Creek, Michigan that have passed a Resolution of Concurrence to participate in the City of Battle Creek's Brownfield Redevelopment Authority.

 

The purpose of a Brownfield Plan is to satisfy the requirements for a Brownfield Plan as specified in Act No. 381 of the Public Acts of 1996, MCLA 125.2651 et. seq., which is known as the "Brownfield Redevelopment Financing Act." Act 381 of 1996 an Act to authorize  municipalities to create a brownfield redevelopment authority to facilitate the implementation of brownfield plans; to create brownfield redevelopment zones; to promote the revitalization, redevelopment, and reuse of certain property, including, but not limited to, tax reverted, blighted, or functionally obsolete property; to prescribe the powers and duties of brownfield redevelopment authorities; to permit the issuance of bonds and other evidences of indebtedness by an authority; to authorize the acquisition and disposal of certain property; to authorize certain funds; to prescribe certain powers and duties of certain state officers and agencies; and to authorize and permit the use of certain tax increment financing.

 

A Brownfield Redevelopment Plan is an urban redevelopment program which recognizes eligible reimbursable expenses that will be incurred by the developer and owner. Approval means a portion of the new property taxes that would be created when the project is completed can be captured by the City's Brownfield Redevelopment Authority and used to reimburse the project owner.

 

The State of Michigan has changed the reporting process for Brownfield Plans and has increased their reporting requirements. The 24 listed Brownfield Plans have been completed or have not been acted upon during at least the past two years. If a project for which eligible activities were identified and the plan fails to occur with respect to eligible property for at least two-years following the date of approval by the Board, the project should be terminated. MDEQ and MEDC have provided BCU staff with the protocol for closure of these projects.


DISCUSSION OF THE ISSUE

POSITIONS
At their board meeting on April 17, 2018 and May 8, 2018, the Battle Creek Brownfield Redevelopment Authority (BCBRA) held public hearings to close out the 24 Brownfield Plans, and the Board approved the termination of the plans.
