Resolved by the Commission of the City of Battle Creek:

 

That the City Commission desires to amend the Employment Agreement with Rebecca Fleury for the position of City Manager, while also recognizing the City Manager's overall performance rating of Exceeds Expectations. 

 

This resolution authorizes the Mayor to execute the amended employment agreement on behalf of the Battle Creek City Commission and to award a lump sum performance bonus of $3,415.78, which represents 2.5% of the City Manager’s current base salary.

SUMMARY 

A Resolution authorizing the Mayor to sign the amended Employment Agreement with Rebecca Fleury for the position of City Manager, while also recognizing the City Manager's overall performance rating of Exceeds Expectations, pursuant to the terms of Section 4 of the Employment Agreement between the City Manager and the City Commission.


BUDGETARY CONSIDERATIONS

This Resolution would amend the Employment Agreement between the City Commission and City Manager Rebecca Fleury to increase the base salary by 5%, to $143,463 and award a 2.5% bonus to the City Manager in the amount of $3,415.78 from 101.01.2200.703.010, City Manager Regular Salaries and related fringes.


HISTORY, BACKGROUND and  DISCUSSION

The Employment Agreement between Ms. Fleury and the City Commission states that the City Commission shall complete an evaluation of Ms. Fleury's job performance and a review of her base salary on an annual basis. 

 

The Employment Agreement provides Ms. Fleury's base salary may be adjusted upward or downward on an annual basis at the discretion of the City Commission.

 

The City Manager Performance Evaluation Committee has been meeting throughout the year to conduct the review of Rebecca Fleury, City Manager, in accordance with the contract between Ms. Fleury and the City Commission. 

 

Ms. Fleury has not received an increase in her salary, other than cost of living adjustments consistent with COLA adjustments as were provided for other city employees.  Ms. Fleury's contract does not provide for step increases as other staff members receive.  Therefore, the Committee believes the salary adjustment is appropriate and deserved.

 

Additionally, on an annual basis, the City Commission may, in its discretion, award Ms. Fleury a bonus based upon meritorious performance for the year to be paid in accordance with the City's "City Manager Evaluation Process" adopted by the City Commission on February 3, 2015, by Resolution 80 (the "Evaluation Policy").    If, in accordance with the Evaluation Policy, the City Commission decides to award Ms. Fleury a bonus, then it shall be based upon performance beginning October 1, 2017 through the date of the job performance evaluation. 

 

If awarded, the bonus shall 1) be paid as a one-time lump sum payment; 2) be included in the earnings history of Ms. Fleury’s salary for purposes of calculating her final average compensation; and 3) be based upon performance beginning October 1, 2017, through the date of the job performance evaluation, September 30, 2018.

 


DISCUSSION OF THE ISSUE

POSITIONS

The City Manager Performance Evaluation Committee is recommending Ms. Fleury's salary be adjusted to acknowledge her accomplished performance as City Manager over the last four years, the increased skill sets she brings to the role, and her upgraded performance now as an experienced City Manager in a city the size of Battle Creek.  Her bonus payments have recognized her performance for each given year.  The Committee desires to recognize Ms. Fleury's performance, expertise and what she brings to the city going forward by recommending an increase to her base salary.

 

Passage of this resolution will result in a 5% wage increase for the City Manager, effective October 1, 2018 and a 2.5% bonus effective immediately.
