Resolved by the Commission of the City of Battle Creek:
That an Independent Contractor Agreement to engage the services of City retiree Brad Duck to perform temporary duties as a Quartermaster for a period not-to-exceed 720 hours is approved.
I, Victoria Houser, City Clerk of the City of Battle Creek, hereby certify the above and foregoing is a true and correct copy of a Resolution adopted by the Battle Creek City Commission at a Regular meeting held on January 7, 2020.

| BUDGETARY CONSIDERATIONS
| Per the contract, the City agrees to pay Brad Duck $31.00 dollars per hour for services provided from budget 101.14.3060.703.010.
| HISTORY, BACKGROUND and DISCUSSION
| The City's Administrative Code (SEC 296.09(c)) prohibits the direct employment of an individual who has retired under the provisions of the Police and Fire Pension. The Battle Creek Police Department currently has an immediate need for a Quartermaster; which was the position Brad Duck held prior to his retirement in April of 2019. The City's Administrative Code prohibits the employment of individuals who have retired from the provisions of Police and Fire Pension; however, the City Manager may make exceptions to this provision with the approval of the City Commission when she feels the interests of the City would be served thereby. In this particular case, the immediate need for help in the department along with Brad Duck's skills and availability, justify an exception to the Administrative Code provisions.
