The City of Battle Creek Ordains:
Section 1. An ordinance (04-2020) to add Chapter 818 regulating the operating of Hotels, Motels and Tourist Homes within the City of Battle Creek, as is attached and made a part hereof.
Section 2. Should any section, clause or phrase of this Ordinance be declared to be invalid, the same shall not affect the validity of the Ordinance as a whole, or any part thereof, other than the part so declared to be invalid.
Section 3. All ordinances or parts of ordinances, in conflict with any of the provisions of this Ordinance, are hereby repealed, saving any prosecution, criminal or administrative appeal pending on, or violation cited on or before the effective date of this ordinance, which shall remain subject to the ordinance provision existing at the time of the alleged violation.
Section 4. This Ordinance shall take effect ten (10) days from the date of its adoption, in accordance with the provisions of Section 4.3(B) of Chapter 4 of the City Charter.

| A Proposed Ordinance 04-2020 to amend the City Code by adding a new Chapter, designated as 818, Regulating Hotels, Motels and Tourist Homes within the City of Battle Creek.
| BUDGETARY CONSIDERATIONS
| There are not any immediate known impacts to the budget. If adopted, fees would be paid with the application and would be set in an amount to cover the City's costs for inspections and enforcement.
| HISTORY, BACKGROUND and DISCUSSION
| Members of the city commission requested that a workshop be conducted to study concerns related to some problem hotels and motels within the City since the quality, safety and aesthetic condition of hotels and motels in Battle Creek are a reflection of community values. First impressions are a reflection of the community as a whole.
That workshop took place March 19. 2019 and the power point presentation from that workshop is attached.
In 2000, the state legislature repealed the bulk of the statutory regulation of hotels and motels, which included eliminating hotel requirements, eliminated a statewide hotel inspector, and eliminated the state commission which was to oversee the safety and minimum requirements for hotels and motels. As a result, there are very few state statutes that regulate the operation of hotel and motel businesses.
A number of Michigan municipalities have adopted their own ordinances to regulate these business establishments in an attempt to provide some oversight on a local level since having safe, well maintained hotel and motel properties positively shape resident perceptions. In addition, safe and well maintained hotels and motels provide desirable places for potential employment recruits to stay when visiting and interviewing at local businesses, corporations and branches of military.
Staff from various city departments have engaged in numerous meetings to discuss desired provisions for a hotel, motel and tourist home regulatory ordinance, which is reflected in the attached proposed ordinance.
